Quality Horse Service's liability is excluded by the outsourcing of transport to the performing party. Therefore, Quality Horse Service cannot be held liable for damage before, during, and after transport, or for the provision of equipment, including during freelance transport, in any form whatsoever. Quality Horse Service and their European partners for road transport operate under the conditions of the AVC and CMR. Consequently, coverage in the event of an accident is minimal, and we therefore advise you to take out additional insurance for your horse. In accordance with Article 11, paragraph G of the AVC and Article 17, paragraph 4, paragraph F of the CMR, horses are transported and cared for at the owner's own risk. Shipment of equipment is at the owner's risk.
If a party hired by Quality Horse Service decides to cancel, modify, or otherwise adjust the transport, Quality Horse Service cannot be held responsible or liable for any consequential damages. If alternatives are offered at a higher rate, the client may choose to agree to this by paying the rate difference, or to cancel the entire booking without further consequences or costs. All costs incurred for extra care during transport or during the pre- and/or post-trip will be passed on to the client. The transporter, driver, or escort assesses what care is required and arranges this on-site. This includes veterinary costs, extra stabling, additional transport costs, and unforeseen expenses. Upon request, these costs may be invoiced to the owner or other interested party, but the client remains ultimately responsible.
Clients are required to report all details regarding the horse to be transported or the inspection to be carried out in writing. Damage caused by a horse is at the client's expense. Quality Horse Service may refuse or cancel orders at any time without providing reasons.
In the event of cancellation within 24 hours prior to loading, the client is in principle obliged to pay the full transport price in accordance with the agreed terms. In exceptional cases, it is possible to reach a compromise, depending on the costs of the hired transporter, or to offer an alternative solution. This will be reviewed and communicated on a case-by-case basis.
The stated rates are always exclusive of VAT and travel documents, unless otherwise stated. If fuel prices rise by 10%, this may be passed on to the customer. The stated transport rates also apply to collective transport, unless otherwise stated. Shared transport is organized by having different customers travel on a single transport. Consequently, there are many factors influencing the schedule, and it is possible that, despite prior agreements, the horse or horses may be loaded or unloaded at night. Quality Horse Service cannot under any circumstances be held liable for damage or costs resulting from a delayed loading or unloading procedure for the horse. This exclusion of liability also applies to direct transport, private transport, or otherwise, where the customer has a truck fully at his or her disposal, regardless of the purpose.
All horses for which transport or other services are performed must be in possession of a valid horse passport. An exception to this applies to horses imported from a country outside Europe. If a horse does not have a studbook passport but a passport for breeding and production animals, the customer is obliged to report this in writing in advance. If this obligation is not met, any additional transport costs will be charged to the customer in accordance with regulations. In principle, horses transported across national borders within Europe must be provided with a TRACES certificate, and horses transported outside Europe must be provided with a health certificate. If this certificate is missing through no fault of Horse & Transport, the transport costs will be borne by the client. The horse cannot be transported and will not be loaded due to the missing health certificate or TRACES certificate. Any additional stabling costs and consequential damages will be borne by the client.
If breeding and production animals are registered as stallions in TRACES at the client's request, Quality Horse Service cannot be held liable for any consequences or damages.
The FAVV is engaged by Quality Horse Service on behalf of the client. By agreeing to a quotation or selecting a final application via an application form on the website, the assignment becomes binding. The application to the FAVV will only be submitted after receipt of invoice payment. Only complete applications will be processed. The application and payment must be received no later than two working days before the inspection date at 5:00 PM.
